1. Definitions
- Application ("App") — the Mirror software downloaded to your device.
- App Store — the Apple App Store (Apple Inc.), through which the Application is distributed.
- Operator ("we," "us," "our") — SIA SCADA, Rīga, Rūpniecības iela 32B - 1I, LV-1045, Latvia, European Union.
- Service — the Application and its associated features.
- Providers — third-party companies involved in providing the Service: Anthropic, PBC (generating the AI analysis), OpenAI Ireland Ltd. (converting voice input to text), Vercel Inc. (hosting the Operator's proxy, which only relays AI-analysis and voice requests in transit to those providers and stores nothing), and Apple Inc. (App Store distribution, iCloud storage, and payment processing).
- Content — texts (including those dictated by voice and subsequently converted to text), mood ratings, and other data that you enter into the Application.
- Subscription — paid access to part of the Service's features on a recurring basis.
- In-app Purchase — the purchase of a product, feature, or Subscription within the Application.
- Free Trial — time-limited free access to a Subscription.
- Country — the Republic of Latvia, European Union.
- You — the person using the Service.
2. Acceptance of the Terms
By using the Application, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions (the "Terms"), as well as the Privacy Policy, which forms an integral part of them. If you do not agree, do not use the Application. Use of the Application is also subject to the rules of the App Store.
3. What the Application Does
Mirror is a personal diary and mood tracker. The Application lets you record a mood rating on a scale from 1 to 7, add text entries (including by dictating them by voice with subsequent conversion to text), view statistics and charts, and receive an automatic analysis of patterns generated by an artificial-intelligence system (the "AI analysis"). The Application is intended solely for self-observation and informational purposes.
4. The Application Is Not a Medical Service
- The Application is not a medical device or a means of diagnosing, treating, preventing, or monitoring any disease.
- The Application makes no claim of any therapeutic, curative, or other health benefit.
- The Application and its contents (including the AI analysis) do not constitute medical, psychological, psychiatric, or other professional advice.
- The Application does not replace consultation with a qualified physician, psychologist, psychotherapist, or other specialist.
- We are not physicians, psychologists, or psychotherapists, and we do not enter into a "doctor–patient" relationship with you.
- NO INFORMATION IN THE APPLICATION SHOULD BE USED TO MAKE A DIAGNOSIS OR HEALTH-RELATED DECISIONS. FOR ANY HEALTH MATTERS, CONSULT A QUALIFIED PROFESSIONAL.
5. AI Analysis: Nature and Limitations
- The AI analysis is generated automatically and is probabilistic in nature. It may contain inaccuracies, errors, or incomplete or misleading conclusions.
- The "patterns," "triggers," and "factors" identified are statistical coincidences in your entries and do not prove any cause-and-effect relationship.
- YOU MUST TREAT THE RESULTS OF THE AI ANALYSIS CRITICALLY AND VERIFY THEM YOURSELF, AND MUST NOT MAKE IMPORTANT DECISIONS BASED ON THEM WITHOUT INDEPENDENT VERIFICATION AND, WHERE NECESSARY, CONSULTING A SPECIALIST.
- WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY, OR FITNESS OF THE AI ANALYSIS FOR ANY PURPOSE, AND WE ARE NOT LIABLE FOR DECISIONS MADE ON ITS BASIS.
Fair use. The AI features are designed for ordinary personal use. The Operator may set reasonable limits on the use of the AI features (including daily limits) and may restrict, suspend, or terminate access to them in the event of use that substantially exceeds ordinary use, or attempts to systematically or automatically exhaust the available limits. In particular, the AI features draw on a fair-use allowance per user; the app signals as usage approaches the allowance and pauses the AI features once it is exhausted, until the allowance renews. Mood logging and all locally stored data remain fully available at all times.
6. Beta and Experimental Features
Certain features may be offered as beta or experimental. They are provided solely for evaluation purposes, "as is," without any warranties, and may be changed, restricted, or discontinued at the Operator's discretion at any time.
7. Age Requirement
The Application is intended for persons aged 16 and older and is not directed to children under 16. If you are under 16, you must not use the Application unless this is permitted by applicable law and authorized by your parent or legal guardian. By using the Application, you confirm that you meet these requirements.
8. Emergencies and Crisis
The Application is not intended for use in emergencies and is not a crisis support service. If you or another person are in danger or experiencing thoughts of harming yourself or others, contact emergency services or a local crisis support service immediately. The Application does not monitor your condition in real time and cannot provide emergency assistance.
9. Data, Storage, and Privacy
- Your entries (ratings and texts) are stored locally on your device and in your personal iCloud storage. The Operator does not store your entries on its own servers and cannot access the copies kept on your device and in iCloud. When you use the AI or voice features, the relevant content passes through the Operator's proxy only in transit to the Providers; nothing is stored on the proxy.
- No review or monitoring of Content. The Operator does not review, moderate, or monitor your entries or other Content, has no knowledge of their contents, and assumes no obligation to do so. Content transmitted when you use the AI or voice features is processed automatically and in transit only; it is not read by any employee or agent of the Operator.
- Mood and diary entries may fall within a special category of personal data (Art. 9 GDPR). Because they are stored on your device and in iCloud rather than on the Operator's servers, you manage them directly in the Application — you view, edit, delete, and export entries, and you can delete them together with the Application and the iCloud copy.
- The Operator processes this data only when, and to the extent that, you use features requiring transmission (AI analysis, voice input). These features can be turned off at any time — in the Application's settings and, for features using system permissions (the microphone for voice input, access to Apple Health), also in your device settings. After they are turned off, the corresponding features become unavailable, and data already transmitted to the providers is, as a general rule, deleted by them within 30 days. The detailed processing is described in the Privacy Policy.
- Artificial-intelligence features (optional). If you use the AI analysis, the entry text, the rating, and the metrics attached to the entry (including Apple Health data, if connected) are transmitted without user or account identifiers to a third-party AI provider (Anthropic, PBC) solely to generate the analysis. Under the provider's current policy, such data is, as a general rule, deleted from its servers within 30 days and is not used to train models by default; the processing is governed by the provider's terms and privacy policy (https://www.anthropic.com/legal/privacy). You can switch the Application to Local Mode in the settings at any time: entries created in Local Mode are never transmitted for AI processing, even if you later switch back. If you do not use the AI features, the text of your entries does not leave your device and iCloud.
- Voice input (optional). If you dictate text by voice, the audio recording is transmitted to a third-party speech-recognition provider (OpenAI Ireland Ltd.) for conversion to text. Under the provider's current policy, such data is, as a general rule, deleted from its servers within 30 days and is not used to train models by default, unless longer retention is required by law; the processing is governed by the provider's terms and privacy policy (https://openai.com/policies/). The recognized text is then processed as a regular entry.
10. Data Integrity and Backups
Because data is stored locally and in your iCloud, its integrity depends, among other things, on your device and on the Apple iCloud service, which the Operator does not control. To the maximum extent permitted by applicable law, the Operator does not guarantee against loss or corruption of data and is not liable for such loss or corruption, including iCloud synchronization failures. You are solely responsible for your data and for maintaining an independent backup of it, including by using the export feature.
11. Third-Party Services
The operation of the Application depends on third-party services (the App Store, the operating system, iCloud, the AI provider, the speech-recognition provider). To the maximum extent permitted, the Operator is not liable for interruptions, changes, unavailability, or discontinuation of such services or for the consequences thereof. Use of third-party services is governed by their own terms.
12. Subscriptions and Payments
- Plans. The Service may offer several Subscription plans (for example, Premium and Premium+) that differ in the features they include. The current plans, their contents, prices, billing period, and the length of any Free Trial are shown in the Application on the purchase screen.
- Term and auto-renewal. Some features are available only with a paid Subscription. Payment is made in advance on a recurring basis. At the end of each period, the Subscription renews automatically on the same terms until you cancel it.
- Cancellation. You can cancel renewal in your App Store account settings. Deleting the Application does not by itself cancel the Subscription — it must be canceled separately. No refund is provided for a period already paid; access continues until the end of the paid period.
- Billing and refunds. All payments are processed by the App Store (Apple) and are governed by its terms. The Operator has no access to your payment data and cannot issue a refund itself. Send refund requests to Apple.
- Price changes. The Operator may change the price of the Subscription. A change takes effect from the start of the next period; you will be given reasonable prior notice with the opportunity to cancel the Subscription before the change takes effect.
- Free Trial. If you provided payment details when starting a Free Trial, then at its end, unless the Subscription is canceled, you will be automatically charged for the selected Subscription type.
- Right of withdrawal (EU). If you are a consumer in the EU, you have the right to withdraw from the contract within 14 days. By requesting immediate access to paid features, you give your express consent to begin performance of the service immediately and acknowledge that the right of withdrawal ends once performance has actually begun, to the extent established by law.
13. In-app Purchases
All billing and transaction processes for in-app purchases are carried out by the App Store and are governed by its terms. For questions about payment, renewals, and refunds, contact the App Store or the Operator.
14. User Content
- You retain all rights to your Content. The Operator claims no ownership of your entries.
- You grant the Operator a limited license to use your Content solely to the extent necessary for the operation of the Service (including, when you use the AI features, to transmit the text, rating, and attached metrics (including Apple Health data, if connected), without user or account identifiers, to the AI provider in order to generate the analysis), and to enable the sharing feature — to the extent necessary to transmit and display the text you have chosen to share.
- You are fully responsible for your Content, its legality, and the consequences of entering it. Please do not enter personal or sensitive data of third parties.
- Sharing. If you use the sharing feature, you decide what text to share and with whom, and you are responsible for this. Once you have shared text, it leaves the private environment of the Application, and the protections described in the sections on data and integrity (§9–§10) no longer apply to the shared copy; recipients can view, save, and forward it. The Operator is not responsible for recipients' actions. Do not include third parties' personal data in shared text.
15. Feedback
If you send the Operator ideas, suggestions, feedback, or bug reports ("Feedback"), such Feedback is considered non-confidential. You grant the Operator a free, non-exclusive right to use it without restriction to develop and support the Service, and you confirm that you hold the rights necessary to do so.
16. License
The Operator grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes on devices that you own or control, in accordance with these Terms and the App Store rules.
17. Intellectual Property
The Service and its original content (excluding your Content), features, and design belong to the Operator and its licensors and are protected by intellectual-property laws. The Operator's trademarks may not be used without its prior written consent.
18. Acceptable Use
The following are prohibited:
- using the Application for unlawful purposes or in violation of applicable law;
- entering, processing, generating, or distributing through the Application content that is unlawful or prohibited by applicable law (in particular, child sexual abuse material);
- using the AI-analysis and voice-input features to process or generate content that violates applicable law or the acceptable-use policy of the relevant provider (Anthropic, OpenAI);
- decompiling, disassembling, reverse-engineering, or modifying the Application, or creating derivative works, except where expressly permitted by law;
- interfering with the normal operation of the Service or accessing it by means other than the standard interface, including by automated means;
- using the Service to create a competing product or for other competitive purposes;
- using the sharing feature to distribute unlawful content, content that infringes third-party rights (including intellectual-property rights), defamatory content, or content that violates the rights and privacy of others;
- using the Application to cause harm to yourself or others.
You use the Application entirely at your own risk. You are responsible for the security of your device and account.
19. Modification and Discontinuation of the Service
The Operator may at any time modify, supplement, replace, or discontinue features of the Application or the Application as a whole for technical, legal, or other reasons. Such changes do not give rise to any right to a refund unless otherwise required by applicable law. The Operator may suspend or terminate your access if you breach these Terms. You may stop using the Application at any time by deleting it.
20. Disclaimer of Warranties ("AS IS")
The Service is provided "as is" and "as available," with all faults, without warranties of any kind. The Operator disclaims all warranties, express or implied, including warranties of fitness for a particular purpose, title, and non-infringement of third-party rights. The Operator does not warrant that the Service will meet your requirements or operate uninterrupted and error-free, and makes no representations regarding the accuracy, reliability, or timeliness of any information provided through the Service.
21. Limitation of Liability
The Operator and its suppliers, directors, and employees are not liable for any indirect, incidental, special, or consequential damages (including lost profits, loss of data, disruption, or moral harm) arising from the use of, or inability to use, the Service. The Operator is also not liable for moral harm or for any harm to health or to physical or emotional condition arising in connection with the use of the Service or from reliance on its contents (including the results of the AI analysis). The Operator's aggregate liability on any basis is limited to the amount you actually paid for the Service over the last 12 months.
22. Indemnification
You agree to indemnify the Operator for losses, claims, and expenses arising directly or indirectly from your actions in using the Application in violation of these Terms or applicable law, to the extent permitted by law in relation to a consumer.
23. Apple App Store Terms
- These Terms are concluded between you and the Operator, not with Apple. Apple is not responsible for the Application or its contents.
- Apple has no obligation to provide maintenance and support for the Application; the Operator is responsible for that.
- If the Application fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price (if applicable); to the maximum extent permitted, Apple has no other warranty obligations.
- Apple is not responsible for claims relating to the Application (product liability, non-compliance with law, consumer-protection and intellectual-property claims).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
24. Governing Law and Dispute Resolution
These Terms are governed by the law of the Republic of Latvia, without regard to conflict-of-law rules. In the event of a dispute, you agree first to attempt to resolve it out of court by contacting the Operator. Disputes are subject to the jurisdiction of the competent courts of Latvia, unless otherwise provided by the mandatory consumer-protection rules of your country of residence in the EU. EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform.
25. Miscellaneous
- Severability. If any provision is held invalid or unenforceable, it shall be interpreted in the closest permissible sense, and the remaining provisions shall remain in force.
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and the Operator regarding the Service.
- No waiver. Failure to exercise a right does not constitute a waiver of it.
- Assignment. The Operator may assign its rights and obligations under these Terms (for example, in a reorganization or sale of the business). You may not assign your rights without the Operator's consent.
- Survival. The provisions on intellectual property, disclaimer of warranties, limitation of liability, and indemnification survive termination of the Terms.
- Force majeure. The Operator is not liable for non-performance caused by circumstances beyond its reasonable control.
- International use and availability. The Service is operated by the Operator from Latvia. The Operator does not guarantee that the Service is suitable or available in all countries; certain features may be unavailable in some regions. You use the Service on your own initiative and are responsible for compliance with applicable local law.
- Electronic notices. You agree to receive notices, agreements, and other information in electronic form (through the Application or by email); such communications are deemed equivalent to written form. This does not affect your statutory rights as a consumer.
- Time limit for claims. To the extent permitted by applicable law, any claims relating to the Service must be brought within one year of the date the cause of action arose. This clause does not apply where it conflicts with mandatory consumer-protection rules.
26. Changes to the Terms
The Operator may amend or replace these Terms. You will be notified of material changes through the Application at least 30 days before they take effect. Continued use after the changes take effect constitutes acceptance of them. The Operator determines, at its reasonable discretion, which changes are material.
